Americas Gold Says Court Dismisses Class Action Lawsuit Against Company

Americas Gold & Silver Corp. said Wednesday that an Ontario court has shut down a case brought against the company and its chief executive last year regarding disclosures around the company’s mine in Nevada.

The precious metals mining said the Ontario Superior Court of Justice ruled that a putative class action lawsuit brought against it in the summer of 2021 regarding the Relief Canon mine cannot proceed.

Americas Gold said that the court in its decision dismissed the plaintiff’s motion for leave to begin a secondary market claim under the Ontario Securities Act. The court found the plaintiff didn’t present credible evidence in its favor, and it dismissed a motion to certify and prosecute the claims as a class proceeding, the company said.

The decision won’t be appealed, Americas Gold said, putting an end to the class action lawsuit.
